To register, provide comments or content, request information or services via a contact form, book events or use any materials from Everlief Child Psychology Limited you must be 18 years of age or over. 1. Purchase Contract

1.1 This web site is operated by Everlief Child Psychology Limited (“we”, “us” or “our”). By using the everlief.co.uk website you are bound by these terms and conditions. All use and event bookings made on this web site are governed by these Terms and Conditions.  The Terms and Conditions governing any given use or booking will be those in effect at the date of your booking or specific use. If you use services or make bookings after we have published any changes to these Terms and Conditions, you will be bound by those changes. Accordingly, you should check our Terms and Conditions each time you use our services or order goods from us to ensure that you understand the precise terms and conditions applicable to your site visit or booking. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date that these Terms and Conditions were most recently updated at the top of our Terms and Conditions.

1.2 We will confirm acceptance of your booking. This will occur either by message on the everlief.co.uk website immediately after you have made your booking, or by us sending you an e-mail booking confirmation to the e-mail address you have provided to us. We may do both, in which case the acceptance will occur on whichever arrives sooner of the web message and the e-mail. At this point the purchase contract will be made and we will supply the event to you in accordance with your booking and these Terms and Conditions.

1.3 You must be 18 years old or over and must have completed the registration process in order to participate in any aspect of our service except: browsing or downloading information or content from our website and making enquiries.

2. Charges

2.1 The price of the booking you make will be as quoted on the web site at the time you confirm your order (usually by clicking the “checkout” button) subject only to any inadvertent technical error for which we will not be liable.

2.2 Everlief is exempt from VAT and so no VAT will be shown or charged.

3. Methods of Payment

3.1 Payment may be made by PayPal via a linked account or with a PayPal approved credit card. You cannot pay for your online booking by cash or cheque.

3.2 The debit and credit cards accepted by us are detailed on the PayPal web site on the date on which your booking is placed.

3.3 Authority for payment may be requested from your card issuer at the time of your order. We reserve the right to terminate our agreement with you if we are refused authority for payment or reasonably believe that payment will be refused at any stage.

3.4 You agree to compensate us in full against all reasonable costs, expenses and outgoings incurred by us in obtaining payments from you in the event a failed payment occurs.

4. Amendment of Orders and Cancellation Rights

4.1 Please contact us as early as possible if you have to cancel an appointment. We will not charge you for cancellations, unless you give us less than 48 hours’ notice.

With 24-48 hours notice we charge 50% of the appointment cost unless you rebook.

With less than 24 hours notice we need to charge the full price as we will have reserved the space for you and it will not be possible for us to offer the time for another family.

4.2 If we have to Cancel or change your booking: Sometimes things we cannot control like the weather conditions or illness of the clinicians will give us reason to cancel at short notice. We will try and give you as much notice as possible and will give you a full refund or transfer your booking to another date.

5. Warranties and Disclaimers

5.1 Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, breach of contract or breach of statutory duty, nor will any of these terms restrict any of your statutory rights.

5.2 We will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.

5.3 To the maximum extent permitted by law, Everlief Child Psychology Limited accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. Users should be aware that they use the Website and its Content at their own risk.  Other than as set out in clause 5.1, our maximum liability arising out of any booking for an event under this contract will be limited to the price of the event in that booking.

5.4 Everlief Child Psychology Limited makes no warranty or representation that the Website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service or Services.

5.5 No part of this Website is intended to constitute advice and the Content of this Website should not be relied upon when making any decisions or taking any action of any kind.

5.6 No part of this Website is intended to constitute a contractual offer capable of acceptance.

5.7 Whilst Everlief Child Psychology Limited uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, all Users are advised to take responsibility for their own security, that of their personal details and their computers.

6. Privacy

6.1 To help us ensure that we can continue to provide a quality service we record all email communications that we send or receive. Full details of the information we collect and ways in which we use information is contained within our Privacy Policy

6.2 We respect your privacy. The personal information that you give us is held with care and security. We do not sell, rent or transfer this information to third parties for their marketing purposes unless you agree otherwise. Full details can be found in our Privacy Policy

6.3 When you register to use the everlief.co.uk website you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and bookings that occur or are submitted under your password.  Please keep your password secret, as you are entirely responsible if you do not maintain the confidentiality of your password. You are entirely responsible for all bookings placed with us or information given to us under your e-mail address in combination with your password. You must immediately notify us of any unauthorised use of your e-mail address and/or password or any breach of security known to you.

6.4 If you know or suspect that someone else knows your password you should notify us by contacting our Customer Services team via contactus@everlief.co.uk immediately.

6.5 If Everlief Child Psychology Limited has reason to believe that there is likely to be a breach of security or misuse of the everlief.co.uk website, we may require you to change your password or we may suspend your account.

7. Customer Complaints

8. Limitations.

You may not use the everlief.co.uk website for any of the following purposes:

8.1 Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material

8.2 Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice

8.4 Gaining unauthorised access to other computer systems

8.5 Interfering with any other person’s use or enjoyment of the everlief.co.uk website

8.6 Breaching any laws concerning the use of public telecommunications networks

8.7 Interfering with or disrupting any website connected to the everlief.co.uk website

8.8 Making, transmitting upload onto the everlief.co.uk website or store electronic copies of materials protected by copyright without the permission of the owner

8.9 Everlief Child Psychology Limited reserves the right to refuse to post material on the everlief.co.uk website or to remove material already posted on the www.everlief.co.ukwebsite.

8.10 Additionally, you will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:
a) any claim by any third party that the use of the everlief.co.uk website by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;
b) any claim by any third party that the use of the everlief.co.uk site by you infringes that third party’s copyright or other intellectual property rights of whatever nature; and
c) any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the everlief.co.uk website by you.

9. Our Right to Cancel or Suspend Your Registration

9.1 Everlief Child Psychology Limited may suspend or cancel your registration on the everlief.co.uk website immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

9.2 You can cancel this agreement at any time by informing us in writing. If you do so, you must stop using the everlief.co.uk website.

9.3 The suspension or cancellation of your registration and your right to use the everlief.co.uk website shall not affect either party’s rights or liabilities.

10. General

10.1 Whilst every effort has been made to ensure that these Terms and Conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions.  This term shall apply only within jurisdictions where a particular term is illegal.

10.2 All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us. You are permitted to use the material data and content only for your personal use in making enquiries or placing bookings through Everlief Child Psychology Limited, but you may not otherwise copy, reproduce, transmit, publish, display, distribute, commercially exploit, use or create derivative works of any material data and content on the everlief.co.uk website without our prior written permission. Everlief Child Psychology Limited may impose a fee on any proposed use of the material data and content contained on its website, other than for making enquiries or bookings through the everlief.co.uk website.

10.3 You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

10.4 If you breach these Terms and Conditions and everlief.co.uk ignores this, Everlief Child Psychology Limited will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

10.5 Everlief Child Psychology Limited shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.

10.6 A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists outside that Act.

11. Amendments

11.1 We may update these Terms and Conditions from time to time and any changes will be notified on the everlief.co.uk website. These changes will apply to the use of the everlief.co.uk website after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use our website. If you continue to use the everlief.co.uk website after the date on which the change comes into effect, your use of our website indicates your agreement to be bound by our new Terms and Conditions.

12. Website Availability

12.1 Although everlief.co.uk aims to offer you the best service possible, Everlief Child Psychology Limited makes no promise that the services at the everlief.co.uk website will meet your requirements. Everlief Child Psychology Limited cannot guarantee that our service will be fault free. If a fault occurs in the service you receive, you should report it to the Managing Director as soon as possible via contactus@everlief.co.uk. We will attempt to correct the fault as soon as we reasonably can. Your access to the everlief.co.uk website may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. Whenever this occurs, Everlief Child Psychology Limited will attempt to restore the service as soon as it can.

12.2 To the maximum extent permitted by law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

12.3 Everlief Child Psychology Limited accepts no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

13. Applicable Law

13.1 These Terms and Conditions and the relationship between you and Everlief Child Psychology Limited shall be governed by and construed in accordance with the Law of England and Wales and Everlief Child Psychology Limited and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
